Terms and Conditions

1. Introduction

1.1 These Terms and Conditions constitute a legally binding agreement (“Agreement”) between you (the “User”) and Selenium Trading DMCC, a registered company in Dubai Multi Commodities Centre (“Selenify,” “we,” or “us”), concerning your purchase of an international data plan (“Data Plan”) related to a prepaid eSIM (“eSIM”) for use on your personal device (“Device”) from Selenify (the “Service”).

1.2 Future agreements between the User and Selenify may also be subject to additional terms and conditions or documents that may be posted on our website (selenify.com) or other platforms.

1.3 We recommend that you print a copy of these Terms and Conditions for your records.

2. Registration

2.1 The User may register to purchase an eSIM through our website or application. The User must accept the Terms of Use to proceed with the registration and purchase process. Our Privacy Policy and Cookies Policy are accessible on the website at the time of registration.

3. Purchase of an eSIM and Activation

3.1 By purchasing an eSIM from us, you agree to pay all applicable charges in accordance with the selected Data Plan.

3.2 You assume responsibility for the eSIM once it is delivered to you. If your Device is lost or damaged before full payment for the eSIM, you are still obligated to complete the payment.

3.3 If you purchase an eSIM through a third-party distributor, your agreement will be with that third party, and Selenify is not a party to that agreement.

3.4 Selenify offers Data Plans specific to various countries, but availability may be restricted in some regions. Users can browse, select, and purchase these Data Plans through our website or authorised third parties.

3.5 By using the Service, you confirm that you have an unlocked, eSIM-compatible Device necessary for accessing the eSIM.

4. Duration and Termination

4.1 This Agreement begins upon the purchase of the eSIM. Once downloaded onto your Device and the Data Plan activated, the eSIM will remain on your Device even after the Data Plan has been consumed or has expired. You may remove the eSIM at any time through your Device settings, but we recommend not doing so until the Data Plan is fully used or expired.

4.2 This Agreement remains valid until the Data Plan has expired or all credits have been used, as specified in the selected Data Plan.

4.3 This Agreement will terminate immediately if:

4.3.1 The Data Plan is fully consumed or expired.

4.3.2 Selenify suspends your use of the eSIM or Data Plan due to a breach of these Terms and Conditions.

4.4 If you do not delete the eSIM immediately after the Data Plan is consumed or expired, the eSIM will remain on your Device without any warranty. Selenify is not liable for any issues with the eSIM after termination, unless you purchase a new eSIM or Data Plan.

5. Warranty

5.1 These Terms and Conditions do not affect your statutory rights as a consumer.

5.2 Selenify makes no warranty or representation regarding the eSIM or the Service, and all implied warranties (except those required by law) are excluded to the fullest extent permitted.

5.3 Selenify reserves the right to discontinue the sale, provision, or support of any eSIM at any time without prior notice.

6. Service Availability

6.1 Selenify will take reasonable steps to ensure the Service is available at all times, depending on our ability and that of our service providers to maintain network capacity and connection availability.

6.2 Selenify partners with various service providers to deliver the Service. We are not obligated to inform you if we engage third parties to assist with the Service.

6.3 Selenify does not guarantee the quality or availability of the network connection, including but not limited to:

6.3.1 When network maintenance or upgrades are necessary.

6.3.2 When you are in areas not covered by our service providers.

6.3.3 When disruptions occur due to factors beyond our control, such as Device features, regulatory requirements, weather, or physical obstructions.

7. User Obligations

7.1 The User agrees to:

7.1.1 Use the eSIM in compliance with these Terms and Conditions.

7.1.2 Use the eSIM according to all applicable laws and regulations of the country where they are located.

7.1.3 Refrain from using the eSIM for illegal or fraudulent activities or actions that may damage or impair the network.

7.1.4 Not use the eSIM to copy, store, modify, publish, or distribute Selenify’s commercial information without permission.

7.1.5 Avoid excessive data usage that may impair the service.

7.1.6 Not use the eSIM in a way that infringes on third-party intellectual property rights.

7.2 The User agrees not to exploit any promotions, credits, or referral programs in a manner that undermines the integrity or fairness of the Service.

7.3 Selenify may suspend the Service for any breach of these Terms and Conditions, and the User will remain liable for all associated charges. Selenify reserves the right to seek legal remedies, including damages and costs.

7.4 Selenify may, at its sole discretion, remove a User’s account or disqualify a User from using the Service or participating in promotions if these Terms and Conditions are breached.

8. Payment Terms

8.1 The User may register and purchase the eSIM through our website. Payment is processed by an authorised agent of Selenify.

8.2 All eSIMs are prepaid, and prices include any applicable taxes unless otherwise specified. Taxes are applied based on the location provided during payment.

8.3 “Indirect Taxes” refer to any applicable sales tax, value-added tax, or similar levies at the time of sale.

9. Legal Right of Withdrawal

9.1 If you are purchasing an eSIM as a consumer, you have the right to withdraw from this Agreement within 14 days without giving any reason. This withdrawal period expires 14 days after purchase, or if the eSIM has been activated and the Data Plan consumed, you will receive a partial refund proportional to the remaining value.

9.2 To exercise your withdrawal right, please contact Selenify Customer Support at support@selenify.com.

10. Refund and Returns Policy

10.1 We are committed to providing a Service that conforms with these Terms and Conditions. If you believe the Service does not comply, please contact us. We may provide a full or partial refund depending on the situation.

10.2 For a full refund, the following conditions must be met:

10.2.1 The eSIM was purchased directly from Selenify.

10.2.2 The eSIM has not been activated.

10.2.3 The refund request is made within 30 days of purchase.

10.3 In the following circumstances, we may provide a full or partial refund:

10.3.1 If the Data Plan has been partially used or the eSIM is not fully functional due to network issues.

10.3.2 If the eSIM was purchased and downloaded onto an incompatible or locked Device, and the conditions in 10.2.1 to 10.2.3 are met.

11. Intellectual Property Rights

11.1 The eSIM, website content, and any trademarks or logos are the property of Selenify or its licensors and are protected by copyright and trademark laws.

11.2 No part of the eSIM, website, or content may be reproduced, distributed, or used for commercial purposes without Selenify’s express written consent.

12. Data Protection

12.1 By purchasing an eSIM, you consent to Selenify processing your personal data to provide and improve the Service and prevent unauthorised use.

13. Indemnity

13.1 The User agrees to indemnify Selenify and its affiliates against all losses, costs, damages, and claims resulting from:

13.1.1 Any breach of these Terms and Conditions.

13.1.2 Any other issue arising from your use of the Service outside of these Terms and Conditions.

14. Limitation of Liability

14.1 Selenify excludes all liability for loss or damage incurred through the use of the Service, except where liability cannot be excluded under law. In no event shall Selenify’s liability exceed the amount paid by the User in the 12 months preceding the incident, or €100, whichever is greater.

15. Governing Law and Legal Compliance

15.1 These Terms and Conditions are governed by and construed in accordance with the laws of Dubai, United Arab Emirates. The courts of Dubai shall have exclusive jurisdiction over any disputes arising out of these Terms and Conditions.

15.2 Local laws may also apply to your use of the eSIM, depending on your location.

15.3 The Service is not intended for use in any jurisdiction where it would be illegal. Users are responsible for complying with local laws.

16. Variation of these Terms and Conditions

16.1 We may update these Terms and Conditions periodically:

16.1.1 Any updates will be posted on our website.

16.1.2 We will notify you of any significant changes. You may choose to stop using the Service if you do not agree with the changes, except in cases where:

16.1.2.1 The changes are to your benefit.

16.1.2.2 The changes are administrative in nature.

16.1.2.3 The changes are required by law.

16.1.3 Continuing to use the Service after the changes means you accept the new terms.

17. General

17.1 Selenify may assign or transfer its rights and obligations under this Agreement to any affiliated company without your consent.

17.2 If any part of this Agreement becomes illegal, invalid, or unenforceable, it shall be modified or deleted as necessary to make it valid and enforceable.

17.3 No failure or delay by either party to exercise any right under this Agreement shall constitute a waiver of that right. Rights and remedies under this Agreement are cumulative and do not exclude other legal rights or remedies.

17.4 This Agreement is written in English. In the event of any conflict between the English version and a translated version, the English version shall prevail.
